By signing up for or using any Netify Builds service, you agree to these Terms of Service. If you do not agree, do not use our services. These terms apply to all clients of Netify Builds, a sole proprietorship owned and operated by Eli, based in Dayton, Ohio.
Netify Builds offers the following products:
Bundle discounts of 15% apply when subscribing to two or more monthly products. All services are built, installed, and managed personally by Eli. We reserve the right to update or improve our services at any time.
All monthly and annual subscriptions are billed through Stripe. By providing payment information, you authorize Netify Builds to charge your payment method on a recurring basis at the agreed interval.
We guarantee delivery of your setup code and onboarding materials within 24 hours of signing up. Your subscription does not begin until you activate your service through the client portal — so you are not charged while waiting on installation. If we fail to deliver setup materials within 24 hours, your first month of service is free. This guarantee applies to the delivery of setup materials only, not installation on your website, as installation timing may depend on your web developer's availability.
You may cancel your subscription at any time with no cancellation fees. To cancel, email netifybuilds@gmail.com or use your Stripe billing portal. Cancellations take effect at the end of your current billing period. No partial refunds are issued for unused time within a billing period.

Netify Builds reserves the right to refuse or terminate SMS campaign services for any client whose contact lists appear non-compliant or whose use of the service creates legal risk.
You agree not to use Netify Builds services to:
You are responsible for providing accurate business information during setup. Inaccurate information that causes the bot to provide incorrect answers to your customers is your responsibility. You are also responsible for keeping your contact information and payment method current.
You are responsible for installing the chat widget on your website. We provide the code and instructions, and offer to install it for you at no charge if you provide appropriate access. Installation timing beyond our control does not extend the 24-hour guarantee.
The software, design, and content of Netify Builds products are owned by Netify Builds. The system prompts, chat widget code, and review pages we build for you are licensed to you for use during your active subscription. They may not be resold, redistributed, or used outside of your business without written permission. Upon cancellation, your right to use the licensed materials ends.
To the fullest extent permitted by law, Netify Builds and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of revenue, loss of data, loss of business opportunities, or inaccurate responses from the AI chat assistant.
We aim for maximum uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Anthropic, Railway, Twilio), or force majeure events may cause temporary unavailability. We are not liable for downtime caused by third-party service providers.
We may update these terms from time to time. We will notify active clients by email before significant changes take effect. Continued use of our services after notification constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the courts of Montgomery County, Ohio.
